EU Investment Policy at the crossroads: Five years after Lisbon
The objective of this paper is to examine the current status of the European Union's investment policy since the coming into force of the Treaty of Lisbon (ToL) in 2009, by initially providing a comprehensive overview on the EU's investment competence through the analysis of Article 207 TFEU.
The EU's Common Commercial Policy CCP explicitly includes foreign direct investment (FDI), which automatically grants exclusive competence to the Union to negotiate, adopt and conclude international agreements with third countries, neutralizing the EU Member States (MS) pre-ToL competence in that area.
